Malaysian Foreign Minister to be fined for smoking in non-smoking area, issues an apology

Malaysian Foreign Minister Mohamad Hasan is set to face a fine for smoking in a non-smoking area at a roadside eatery in Negeri Sembilan. The incident, which was widely circulated in a photo, shows Hasan holding a cigarette while sitting with a group of men. Health Minister Dzulkefly Ahmad confirmed that a violation notice would be issued to Hasan for breaching Malaysia’s strict smoking regulations. Under the Tobacco Control for Public Health Act 852, smoking in designated non-smoking areas, such as eateries, can lead to a fine of up to 5,000 ringgit (approximately Rs 95,000).

Malaysia introduced a nationwide smoking ban in all eateries in 2019 as part of the government’s efforts to protect public health and reduce smoking rates. The law prohibits smoking in restaurants, cafes, and other food establishments, including both indoor and outdoor areas. In addition to this, the government implemented further stringent measures in October 2024 to strengthen the enforcement of the smoking ban. These measures aim to ensure better compliance and curb tobacco-related health risks, particularly among non-smokers exposed to secondhand smoke.

The smoking ban also covers several other public spaces, including public transportation, workplaces with centralized air conditioning, government buildings, and educational institutions. However, smoking is permitted in specific areas such as designated smoking rooms, pubs, nightclubs, and non-air-conditioned public transport terminals. Additionally, all forms of tobacco advertising and sponsorship are prohibited under the law, which is designed to minimize tobacco consumption and promote a healthier environment.

Following the incident, Hasan expressed regret for his actions, acknowledging the public's concern. "If it has become a concern and an issue among the people, I would like to sincerely tender my apology," Hasan said in a statement. He confirmed that he had received a violation notice from the Seremban District Health Office and would pay the fine. The Foreign Minister also noted that he hoped the penalty would not be excessively high, although the exact fine amount has yet to be determined. Hasan's office has been informed of the matter, and he has assured full compliance with the law.

The Health Ministry’s statement highlighted that no individual, including ministers and public officials, is above the law. The ministry emphasized the importance of enforcing the smoking ban to maintain public health and safety. Health Minister Dzulkefly Ahmad reiterated that the law would be applied fairly to everyone, regardless of their position. He added that Hasan had requested to be issued the fine and was fully committed to paying it.

Malaysia’s efforts to curb smoking have been part of a broader strategy to address public health concerns related to tobacco use. The smoking ban is intended to reduce exposure to secondhand smoke, which poses serious health risks, and to discourage smoking, especially among younger generations. The government has also implemented smoking cessation programs and awareness campaigns to support individuals in quitting tobacco use.

This incident serves as a reminder of the country’s strict enforcement of tobacco control laws and the government's commitment to upholding public health standards. The fine imposed on Hasan underscores the seriousness with which Malaysia is enforcing these regulations, regardless of an individual’s status or position.
